Terms of Service

Last updated October 25, 2026

These Terms are an agreement between you and [Clary's legal name, e.g. Clary Health, Inc.] ("Clary," "we," "us"). They cover our website, your Clary membership, and our emails and texts. By joining or using Clary, you agree to these Terms, our Privacy Policy and our Consumer Health Data Privacy Policy. If you don't agree, please don't use Clary.

The short version

This summary helps you find your way around. The full Terms below are what apply.

1. Who can join

You must be at least 18, live in the United States, and use an email address and mobile number that are your own. One membership per person. Please give us accurate information and keep it up to date. We use your email and phone to recognize you, so keep access to them secure.

2. Membership and verification

Joining is free and gives you Clary's news and updates. To unlock commenting and members-only perks, you'll complete your profile and a person on our team will verify it. We may ask you for more information, and we may decline or remove a membership that looks fake or duplicated, or that breaks these Terms.

3. Health information, not medical advice

Clary's news, explainers, visuals and community posts are general information. They aren't medical advice, diagnosis or treatment, and reading them doesn't make Clary your healthcare provider. Talk to a qualified clinician before making decisions about your health, and don't delay or ignore professional advice because of something you read on Clary.

If you think you're having a medical emergency, call 911. If you're in crisis, call or text 988.

We work hard to get our explainers right and we cite our sources, but research changes and we can make mistakes. If you spot one, tell us at hello@getclary.org.

4. Your health data

Clary collects private health data, like the health topics you choose. We treat it with extra care:

The only exception is when a law or court order requires us to disclose it. HIPAA, the federal health privacy law for health plans and most medical providers, doesn't apply to Clary. Our Consumer Health Data Privacy Policy and state health privacy laws are what protect your health data. That policy explains what we collect, how we use it and your rights.

5. Members-only perks

Perks are products, services and prices from other companies ("partners") that we arrange for members.

6. Advocacy

When we offer petitions or tools to message lawmakers, you decide what to sign and send. When you do, we deliver your name, your message and the details the form asks for to the people or offices you chose. Each form will tell you what's sent and what's shown publicly. Clary chooses which campaigns to run and can't promise any outcome.

7. Community rules

What you post on Clary, like comments, stays yours. You give Clary a free, non-exclusive license to host, store, display, format and share it on Clary so we can run the community. We won't use your posts in ads or marketing without asking you first. The license ends when you delete a post, except for copies we must keep for legal reasons.

Other members can see what you post, so please don't share anything you want to keep private.

Please don't:

We may remove posts, and suspend or end memberships, that break these rules. To report something, email hello@getclary.org.

8. Emails and texts

Emails. Joining includes getting emails from Clary: health news, perks, events and updates. You can unsubscribe from marketing emails anytime with the link in any of them. We may still send you messages about your membership.

Texts. If you opt in, Clary will send recurring automated marketing texts about drops and events to the mobile number you gave us. Consent isn't a condition of joining or buying anything. Message frequency varies. Message and data rates may apply. Reply STOP to cancel (we'll send one text to confirm), or reply HELP for help. You can also email hello@getclary.org. Carriers aren't liable for delayed or undelivered messages. If you change or give up your number, please reply STOP first or let us know. Our Privacy Policy explains how we handle your number.

9. Clary's content

Clary's site, design, writing, images and name belong to Clary or the people who license them to us. You're welcome to read our content and share links to it. Please don't copy, republish or sell it, or use our name or logo to suggest we endorse you, without our permission.

Clary links to research, news and partner sites. We don't control those sites and aren't responsible for them.

10. Leaving Clary

You can leave anytime by emailing hello@getclary.org. We'll delete your information as our Privacy Policy describes. We may suspend or end a membership that breaks these Terms, or when needed to protect members or Clary. We may also change or stop any part of Clary, and we'll try to tell you first. Sections 11 to 16 still apply after a membership ends.

11. Disclaimers

Clary is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Clary will always be available or error-free, or that its information is complete, current or accurate. Some states don't allow these exclusions, so some of them may not apply to you.

12. Limits on liability

To the fullest extent the law allows, Clary and its team aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Clary, from partners' perks, or from other members' posts. Our total liability for any claim about Clary is limited to $100, or the amount you paid Clary in the 12 months before the claim, if that's more. Nothing in these Terms limits liability that the law doesn't allow us to limit.

13. Your responsibility

If you break these Terms or the law, or something you post leads to a claim against Clary, you agree to cover the reasonable costs that result for Clary, including legal fees.

14. Disputes

The laws of [state] govern these Terms, without regard to conflict-of-law rules. If you have a problem with Clary, please email hello@getclary.org first so we can try to fix it within 30 days. If we can't, any claim will be decided by the state or federal courts in [county, state], and you and Clary agree to those courts. Either of us may bring a claim in small claims court instead.

15. Changes to these Terms

We may update these Terms. We'll change the date at the top, and if a change is significant, we'll email you before it takes effect. If you keep using Clary after that, you accept the new Terms. If you don't accept them, you can leave Clary.

16. The rest

These Terms and our privacy policies are the whole agreement between you and Clary about Clary. If part of them can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given up the right to. You can't transfer these Terms to anyone else. We can transfer them if Clary is merged, acquired or sold.
